These Terms of Service (“Terms”) govern your access to and use of the website located at www.realityfade.com (the “Site”), operated by Reality Fade (“Reality Fade”, “we”, “us”, “our”).

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you must stop using the Site immediately.

We may update these Terms from time to time. The version in force at the time of your use or purchase will apply.

1. ABOUT US

Reality Fade operates an online store offering music-related merchandise and physical media.

When creating an account or placing an order, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials.

3. PRODUCTS & AVAILABILITY

All products displayed on the Site are subject to availability.
Placing an item in your cart does not reserve it.

We reserve the right to:

  • Limit quantities per customer or address

  • Withdraw products at any time

  • Refuse service where legally permitted

4. PRICING, VAT & CURRENCY

Prices are shown in the currency displayed on the Site and may include or exclude VAT depending on your location and applicable law.

If VAT applies, it will be clearly shown at checkout.

If you pay in a currency different from your card’s billing currency, your card issuer may apply exchange rates or fees beyond our control.

In the event of a clear pricing error, we reserve the right to cancel the affected order and issue a full refund.

5. ORDERS & CONTRACT FORMATION

Your order constitutes an offer to purchase.

An order confirmation email only confirms receipt of your order and does not constitute acceptance.
A binding contract is formed once your order has been dispatched.

We may refuse or cancel an order if:

  • Payment authorization fails

  • The item is unavailable

  • Shipping restrictions apply

  • There is a pricing or listing error

  • Fraud or misuse is suspected

If payment has already been taken, a refund will be issued.

6. PAYMENT

We accept payment via Shopify Payments, PayPal, and other methods shown at checkout.

All payments are subject to authorization by your payment provider.
We are not responsible for delays or failures caused by payment providers.

7. DELIVERY

Delivery times shown on the Site are estimates only.

We use tracked shipping services where available.
Once an order has been dispatched, responsibility passes to the carrier, subject to applicable consumer protections.

We are not responsible for delays caused by:

  • Customs procedures

  • Postal disruptions

  • Force majeure events beyond our control

8. RIGHT OF WITHDRAWAL (EU CONSUMERS)

If you are a consumer located in the European Union, you generally have the right to withdraw from a distance contract within 14 days of receiving the goods, without giving a reason.

To exercise this right, you must notify us clearly before the withdrawal period expires.

Returned items must be unused, in original condition, and properly packaged.
Return shipping costs are your responsibility unless otherwise required by law.

Refunds will be issued within 14 days of receiving the returned goods or proof of return.

Exceptions:
The right of withdrawal does not apply where exclusions under EU consumer law apply.

Abusive Returns
We reserve the right to refuse future orders, limit services, or terminate customer accounts where we reasonably believe that a customer is abusing the right of withdrawal, including but not limited to excessive returns, returning items in a used or damaged condition, or behavior inconsistent with good faith consumer practices.

14. GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of Poland.

Any disputes shall be subject to the jurisdiction of the Polish courts, without prejudice to mandatory consumer protections under EU law.

15. SEVERABILITY

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
